Emycra is a personal tool for writing down your migraine attacks and taking them to your doctor in an orderly form. It is not a medical device and it does not replace your relationship with your doctor. By using it you accept these terms.
These terms govern use of the Emycra application for iOS (iPhone), distributed through the App Store by Simone D'Agostino, Calle Ollerías 20, 29012 Málaga, Spain ("the provider"). By installing or using the app you confirm that you have read and accepted these conditions, the Privacy Policy and the Apple licence agreement referred to in section 7.
Emycra lets you record your migraine attacks — start, duration, intensity from 0 to 10, pain location, aura and symptoms — together with the acute medication you take, your preventive therapy with each intake, the triggers you recognise and any notes you want to add. From that data the app calculates statistics, a calendar map, the correlation between triggers and attacks and your adherence to the preventive therapy; it shows a widget with migraine-free days and the attacks this month; it sends you a local reminder for your preventive therapy; and it exports your data as JSON, CSV or a PDF report to show your doctor.
Emycra is not a medical device, it does not diagnose, it does not interpret your symptoms, it does not prescribe medication and it does not provide medical advice. It suggests no doses and no changes of therapy, and it contains no validated clinical scores. The counts and charts it shows are elaborations of the data you enter: they can be incomplete or inaccurate, and they depend on how much you write down and how you do it. They are not clinical measurements and they do not replace an examination or a consultation.
Do not change your therapy on the basis of what the app shows without first speaking to a doctor.
The app is free to download and the diary is complete and free: you can record unlimited attacks — no cap and nothing that expires — together with your acute medication, your preventive therapy with each intake, and your triggers including control days. Exporting your data as JSON or CSV is always available, even if you never buy anything. There is no time-limited trial and no date after which something closes.

Emycra PRO is one product, of the non-consumable kind (com.dagostinosimone.emycra.pro): you pay once, at the price shown in the App Store at the time of purchase, which may vary by country and currency. It does not renew and there are no further charges: there is nothing to cancel, either in the app or in your account settings.
Payment is handled entirely by Apple and is charged to your Apple account when the purchase is confirmed. Any refund follows Apple's conditions: you request it from the site Apple dedicates to this (reportaproblem.apple.com), under App Store rules and the rights the law grants you as a consumer (section 10).
The purchase is tied to your App Store account, not to a single phone: you keep it on other devices with the same account, and you can restore it from the app's settings, for example after reinstalling the app or switching device.
If you do not buy Emycra PRO, the diary stays what it is: you can keep recording attacks, medication, therapies and triggers without limits, and keep exporting everything as JSON or CSV. Only the three PRO features stay closed — the PDF report, the statistics and the Face ID app lock — and you can unlock them whenever you want with a single payment. There is no expiry date, no read-only mode and no data that becomes inaccessible: what you wrote stays yours and stays readable.
We grant you a personal, non-exclusive and non-transferable licence to use the app on Apple devices you own or control, in accordance with App Store rules. You may not decompile, modify, redistribute or resell the app, or extract its code, except as permitted by law.
Use of the app is also governed by Apple's standard End User Licence Agreement (EULA) for applications downloaded from the App Store, which takes precedence over these terms for the matters it covers:

We may update the app to fix errors, improve performance or add features. We may change or replace a feature, but we will not reduce the protections described in the Privacy Policy without asking for your explicit consent again. Your data stays on your device after an update.
The app is provided "as is". To the extent permitted by law, the provider is not liable for damages arising from use of the app, from decisions taken on the basis of the counts it shows, from incorrectly entered data, or from data loss caused by device failure, loss or replacement. This limitation does not exclude liability for wilful misconduct or gross negligence, nor the rights the law grants you as a consumer.
If you purchase as a consumer in the European Union, you have the right to withdraw within 14 days of buying digital content. Because the app supplies digital content with immediate performance, that right of withdrawal may lapse once you expressly consent to early performance. Purchases made through the App Store are handled according to Apple's refund procedures.
These terms are governed by Spanish law. For consumers, the competent court is the one for the consumer's place of residence or domicile. For any other dispute, the courts of Málaga have jurisdiction.
